What rules apply to tobacco and nicotine pack labels in Spain?
CoLabel Team2 min readLast checked
Short answer
Spain follows the EU Tobacco Products Directive. Cigarettes, roll-your-own and heated tobacco with a characterising flavour cannot be placed on the market, and snus cannot be sold. Spain has also drafted decrees on plain packaging and a disposable e-cigarette ban. Neither is in force.

What the law requires
Spain applies the EU tobacco rules. These bans decide what you can put on a label at all.
- Cigarettes: a cigarette with a characterising flavour cannot be placed on the EU market. The ban has applied to all cigarettes since May 2020 (Directive 2014/40/EU, Art. 7(1); Implementing Decision (EU) 2016/787).
- Roll-your-own (RYO) tobacco: the same ban has applied since May 2020, including menthol variants (Directive 2014/40/EU, Art. 7(1)).
- Heated tobacco products: characterising flavours are banned following the removal of the exemptions in October 2023 (Delegated Directive (EU) 2022/2100, amending TPD2 Annex II).
- Snus and other oral tobacco: banned from sale in all EU member states except Sweden (Directive 2014/40/EU, Art. 17). Spain is not Sweden, so this product cannot be labelled for the Spanish market.
Draft measures, not law. Both are tracked under TRIS 2025/0044/ES.
- Spain notified the EU in January 2025 of a draft Royal Decree on standardised plain packaging for cigarettes and RYO. It would remove brand colours, logos and non-standard fonts. As of early 2026 it was still under EU notification review, with multiple member-state objections.
- A draft decree proposes banning single-use disposable e-cigarettes. As of early 2026 it was under EU notification review and not in force.
What to change on your label
- Check the flavour first. If a cigarette, RYO or heated tobacco product has a characterising flavour, remove or reformulate it before you create an EU label.
- Do not create a Spanish label for snus or oral tobacco.
- Hold back brand-heavy artwork for cigarettes and RYO. Do not commit to new packaging that relies on brand colours, logos or non-standard fonts until the final decree is published in the BOE.
- Do not invest in disposable e-cigarette lines for Spain until the final Royal Decree text is published in the BOE.
- Check the BOE before each artwork run. The status above is as of early 2026.
