Short answer

Nicotine pouches and non-nicotine e-cigarettes need a set Polish-language health warning. Most tobacco products also need a Polish excise stamp. Flavoured heated tobacco has been banned since 18 January 2026, and packs must carry no advertising or promotional claims.

What the law requires

The main law is the Act of 9 November 1995 on health protection from tobacco, as amended. Excise stamps come from the Excise Duty Act (Ustawa o podatku akcyzowym). Both are published on ISAP.

Health warnings

  • Nicotine pouches must carry this warning on at least 30% of the packaging: "Ten wyrób szkodzi Twojemu zdrowiu i powoduje uzależnienie." Sale is restricted to people aged 18 and over. The Act was amended by UD86, signed 17 June 2025. For the current status of nicotine pouches in Poland, see this country summary.
  • Non-nicotine e-cigarettes and refill containers have been regulated since June 2025. They must carry: "Wyrób szkodliwy dla zdrowia." Sale to anyone under 18 is prohibited.

Excise stamps

Polish excise stamps (banderole) are required on cigarette packs, cigar packaging, pipe tobacco and HTP sticks. PWPW (Polish Security Printing Works) issues them. Each stamp has holographic security elements and a unique traceability ID.

Flavour bans

  • Heated tobacco in Poland: from 18 January 2026, only tobacco-flavoured (unflavoured) HTPs may be placed on the Polish market. Menthol, fruit, candy, vanilla, herbal and spice variants are prohibited. The amending Act was published in April 2025 and implements Delegated Directive 2022/2100.
  • EU rules that also apply: cigarettes and roll-your-own tobacco with a characterising flavour have been banned since May 2020 (Directive 2014/40/EU, Art. 7(1)). This includes menthol roll-your-own. HTPs with a characterising flavour have been banned in the EU since the exemptions were removed in October 2023 (Delegated Directive (EU) 2022/2100). Snus and other oral tobacco are banned in every member state except Sweden (Directive 2014/40/EU, Art. 17).

Advertising

Poland bans advertising, sponsorship and promotion of tobacco and nicotine products in all channels. The ban covers e-cigarettes and nicotine pouches.

What to change on your label

  • Check the range first. Flavoured HTPs cannot be sold in Poland. Only tobacco-flavoured HTPs can have a Polish label.
  • Use the exact Polish warning text. Copy the wording above without changes, including the diacritics.
  • Size the pouch warning. It must cover at least 30% of the packaging.
  • Plan for the excise stamp. Cigarette packs, cigar packaging, pipe tobacco and HTP sticks need one. Leave room for it in the pack design.
  • Remove promotional claims. Packaging should carry no advertising or promotional claims.
  • Check other markets separately. The EU nicotine pouch guide, the Spanish rules and the German rules cover other markets.

If you manage several Polish label versions, you can keep each one with its warning text in one place using CoLabel label storage and version control.
